Right of withdrawal of the customer

You have the right to withdraw from this contract within fourteen days without giving any reason.

The return shipping costs must be borne by you. We will refund the paid amount immediately after receipt of the returned goods.

In case of unpredictable production difficulties, we have the right to cancel the contract and to return the invoice amount to you.

If packages can not be accepted by customers and are therefore returned to us, the company Johannes Stadler can revoke / dissolve the contract. The paid invoice amount will be refunded immediately upon arrival of the package.

Should one or more provisions of these terms and conditions be ineffective, this does not result in the ineffectiveness of the entire contract. The ineffective regulation will be replaced by the relevant statutory regulation. Bad Ischl / Austria is the exclusive place of jurisdiction. www.help.gv.at

§ 1 Data protection

PKS Bronze – Johannes Stadler stores and uses your orders and personal data including address and e-mail address exclusively to process your orders and any complaints. We only use your e-mail address for information about your order and, if desired, for our own newsletter.

Almost all online shops use tools such as Google Analytics, etracker or Piwik to analyze user behavior. Since personal data may be evaluated here (IP address, customer data, e-mail address for logged-in shop customers, etc.), WE DO NOT USE THIS SERVICE.

§ 2 General

All deliveries and services of the company Johannes Stadler for the customer are carried out exclusively on the basis of the following general terms and conditions in the version valid at the time of the order. Deviating regulations are only valid if they have been agreed in writing between the company Johannes Stadler and the customer.

§ 3 Conclusion of contract

The product information such as dimensions and weight may be subject to slight deviations. By ordering the desired goods on the Internet or via email (office@kupferspuren.at), the customer makes a binding offer to conclude a purchase contract. The offer is binding at the latest when it has passed the respective interface to the Johannes Stadler company. The order confirmation is usually sent immediately by sending an e-mail. In the event of force majeure or if, for example, the product cannot be delivered, Johannes Stadler can withdraw from the contract at any time.

§ 4 Withdrawal / REVOCATION

If the advance payment amount is not recorded within 5 working days after the conclusion of the contract in accordance with § 1 as receipt of money on the account at Johannes Stadler specified in the order confirmation, the company Johannes Stadler has the right to withdraw from the contract and cancel the order.

§ 5 Damage in transit

If goods are delivered with obvious damage to the packaging or the contents, the customer must complain immediately to the carrier/freight service and refuse acceptance. In addition, the company Johannes Stadler must be contacted immediately on Tel. 0043 677 631 482 77 or by other means (email/post). Hidden defects must be reported to Johannes Stadler immediately after they are discovered. A shortening of the statutory limitation periods is not associated with this regulation.

§ 6 Warranty /GUARANTEE

The customer’s claims against Johannes Stadler in the event of defects are based on the statutory regulations within the statutory periods, provided that the following regulations do not result in any deviations. Damage caused by improper or non-contractual measures by the customer, operation or storage do not justify any claims against Johannes Stadler. If the customer is a registered trader and the ordered service is provided for his business, his claims for defects expire one year after receipt of the goods. The product information listed on KUPFERSPUREN.AT is information provided by the manufacturer. We accept no liability for any changes or modes of operation.

§ 7 Limitation of Liability

a) The company Johannes Stadler is only liable for damages other than damage to life, limb and health if these are due to intentional or grossly negligent action or culpable violation of a material contractual obligation by KUPFERSPUREN.AT or vicarious agents (e.g. the delivery service ) from KUPFERSPUREN.AT. Any further liability for damages is excluded. The provisions of the Product Liability Law remain unaffected. b) If an essential contractual obligation is violated negligently, the liability of the company Johannes Stadler is limited to the foreseeable damage. c) According to the current state of the art, data communication via the Internet cannot be guaranteed to be error-free and/or available at all times. KUPFERSPUREN.AT is therefore not liable for the constant and uninterrupted availability of the online trading system or for technical and electronic errors during a sales event over which KUPFERSPUREN.AT has no influence, in particular not for delayed processing or acceptance of offers.
